Please read the waiver below and fill out the required fields found in the following form sections. All liability language from the waiver will apply to all persons listed below.


RELEASE, WAIVER & INDEMNITY

(the "Release")

 

To: Fun Park Amusement Center. (referred to in this Release as "Fun Park")


IN CONSIDERATION of Fun Park allowing the person who has signed below (referred to in this Release as "you") to use Fun Park's facilities located at 1175 Wilkes Ave, Winnipeg Manitoba (referred to in this Release as the "Facilities") and participate in and/or observe events and activities within the Facilities (collectively referred to in this Release as the "Activities"):

  1. You acknowledge and agree that participating in or observing the Activities may cause damage to your personal property, personal injury or illness to you and/or may result in your death;

  2. You confirm that your participation in or observation of the Activities is voluntary;

  3. You assume the full risk of being at the Facilities and your participation in or observation of the Activities;

  4. You fully waive all rights to make or bring any claims, actions, suits or proceedings against Fun Park, whether direct or indirect;

  5. You grant to Fun Park an unrestricted, irrevocable, royalty free right and license to use, reuse, broadcast, exhibit and publish throughout the world, in perpetuity, in any and all publications of Fun Park in any and all media, whether known or unknown, and in all forms, any and all of the digital images of you within the Facilities (the "Images"), or any part of the Images, without compensation to you whatsoever. You waive any and all moral rights or equivalent rights, provided under the Copyright Act (Canada), or otherwise, that you may have in the Images or in any part of the Images.

  6. You release Fun Park from all claims, actions, suits, proceedings, liabilities, losses, damages, costs and expenses (collectively, "Claims") that relate in any way to your attending at the Facilities and/or your participation in or observation of the Activities, including, without limitation, any loss or damage to any of your personal property, and/or the Images;

  7. You agree to indemnify and hold Fun Park harmless from and against any and all Claims that Fun Park may, directly or indirectly, suffer or incur in connection with or related to your use of the Facilities and/or your participation in or observation of the Activities and/or the Images;

  8. By signing below, you agree that you fully understand and agree to the terms of this Release and that you are signing this Release voluntarily.


FOR MINORS (UNDER 18), PARENT OR GUARDIAN TO SIGN BELOW

I am the parent or guardian of the above minor(s) and I permit him or her to attend the Facilities and observe and/or participate in the Activities and agree to the terms set out above on his or her behalf.
